Terms and Conditions

Ascera Tutoring is operated by Harsil Dixit, an individual based in the United Kingdom. All tuition is planned and delivered personally by Harsil Dixit. These terms govern the arrangement between Harsil Dixit (referred to as "we", "us" or "Ascera Tutoring") and the client (referred to as "you"), being the parent, guardian or adult student who engages our services.

By booking a session or engaging our services, you confirm that you have read, understood and agree to these terms.

1. Services

Ascera Tutoring provides private one-to-one and small group online tuition in GCSE and A-Level Maths, Biology, Chemistry and Physics. Sessions are conducted via an online video platform using a shared interactive whiteboard.

The specific subjects, examination board, session frequency and any other arrangements are agreed between the parties prior to the commencement of sessions, either during the free consultation call or by subsequent written agreement.

We make no guarantee of any specific examination result or grade improvement. Outcomes depend on a range of factors including the student's effort, attendance and engagement. We do, however, commit to delivering every session with care, professionalism and a focus on the student's individual needs.

Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, including the right to receive services performed with reasonable care and skill.

2. Booking and confirmation

Sessions are arranged by mutual agreement following an initial consultation. Bookings are confirmed by written communication (email or WhatsApp). A booking is considered confirmed once both parties have agreed the date, time and subject in writing.

The initial free consultation call carries no obligation and does not constitute a booking. No payment is due in respect of the consultation call.

3. Fees and payment

Current rates

All fees are quoted and payable in pounds sterling (GBP). Rates are reviewed periodically. Any change to rates will be communicated in writing with a minimum of four weeks' notice before taking effect for existing clients.

Invoicing

Invoices are issued following the completion of sessions, or in advance for term plan bookings. Payment is due within seven days of the invoice date.

Payment method

Payment is accepted by bank transfer to the details provided on the invoice. Payment should reference the invoice number.

Late payment

Where payment is not received within 14 days of the invoice date, we reserve the right to suspend provision of further sessions until payment is made.

4. Cancellation and rescheduling

Cancellation by the client

We require a minimum of 24 hours' notice to cancel or reschedule a session. The following policy applies:

Notice of cancellation must be given in writing by email or WhatsApp message to hello@asceratutoring.co.uk. Cancellation is effective from the time the written notice is sent to the correct contact, provided it is sent before the relevant 24-hour deadline.

Please note that the 24-hour cancellation policy applies without exception, including in cases of illness, technical difficulties or other unforeseen circumstances. We recommend giving as much notice as possible in all circumstances.

Cancellation by Ascera Tutoring

In the event that we need to cancel a session, we will provide as much notice as possible. The session will be offered for rescheduling at a mutually convenient time. If rescheduling is not possible, a full refund will be issued for that session. We will not charge any fee for sessions cancelled by us.

Exceptional circumstances

In the event of circumstances entirely beyond our reasonable control that prevent the delivery of sessions for an extended period (including but not limited to serious illness, bereavement or other personal emergency), we will notify you as soon as reasonably practicable. We will make every effort to reschedule affected sessions. Where rescheduling is not possible within a reasonable period, a pro-rata refund will be issued for any sessions paid for but not delivered.

5. Term plans

The term plan consists of a block of 12 weekly one-to-one sessions at a discounted rate, paid in advance. The following terms apply specifically to term plan bookings:

6. Conduct and suitability

All tuition is delivered by Harsil Dixit, who holds an Enhanced Disclosure and Barring Service (DBS) certificate. Details are available on request.

We expect all sessions to be conducted in a respectful and productive environment. The client agrees to ensure that the student is available, prepared and in an appropriate setting for each session.

We reserve the right to end a session immediately, without refund, in the event of conduct that is abusive, threatening or otherwise unacceptable. Where such conduct is repeated, we reserve the right to terminate the arrangement in its entirety in accordance with Section 7.

We reserve the right to decline to take on or to continue with a client where we reasonably consider that our services are not suitable for the student's needs, or where the working relationship is not productive. In such circumstances, any sessions already paid for but not yet delivered will be refunded in full.

7. Ending the arrangement

Either party may end the tutoring arrangement at any time by giving written notice by email. There is no minimum notice period for pay-per-session bookings; you may simply stop booking sessions.

For term plan bookings, please refer to Section 5 regarding refunds for unused sessions.

Upon ending the arrangement, any outstanding invoices remain due and payable in full.

8. Liability

We take reasonable care in the preparation and delivery of all sessions. However, we cannot accept liability for:

Where a session is materially disrupted by a technical failure on our side, we will offer to reschedule the session or provide a pro-rata refund for the portion of the session lost.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

9. Intellectual property

All session materials, resources, worksheets and written feedback prepared and provided by Ascera Tutoring remain the intellectual property of Harsil Dixit. They are provided for the personal educational use of the student only and may not be reproduced, shared, sold or distributed without our prior written consent.

10. Privacy

We collect and process personal data in connection with the delivery of our services. Full details of how we handle personal data, including your rights under UK GDPR, are set out in our Privacy Policy, which forms part of the overall arrangement between us.

11. Complaints

If you have a concern or complaint about any aspect of our service, please contact us in the first instance at hello@asceratutoring.co.uk. We will acknowledge your complaint within two business days and aim to provide a full response within ten business days.

We take all complaints seriously and will endeavour to resolve any issues fairly and promptly.

12. General

Governing law

These terms are governed by the laws of England and Wales. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Entire agreement

These terms, together with our Privacy Policy and any written confirmation of session arrangements, constitute the entire agreement between the parties in relation to the provision of tutoring services and supersede any prior representations or agreements.

Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Amendments

We reserve the right to update these terms from time to time. Any material changes will be communicated to active clients in writing with a minimum of four weeks' notice. Continued engagement of our services after that period constitutes acceptance of the updated terms.

Waiver

Failure by us to enforce any provision of these terms on a particular occasion does not constitute a waiver of our right to enforce that provision on any future occasion.
